May 04, 2010 – Naturade®, a division of NNC LLC, receives two favorable rulings in Orange County Superior Court in a lawsuit filed by Scilabs Nutraceuticals, Inc.
ORANGE, CA - (May 4, 2010) - Naturade, a leading brand in the natural products channel for more than 84 years, announced today that the Orange County Superior Court has ruled twice in Naturade’s favor in a lawsuit filed by Scilabs Nutraceuticals, Inc (“Scilabs”). On February 3, 2010 Naturade was successful in defeating a Temporary Restraining Order requested by Scilabs, and on March 3, 2010 Naturade won the court’s ruling at a Preliminary Injunction Hearing. The court stated in its ruling on the request for a Preliminary Injunction that “the court finds that the plaintiff [Scilabs] failed to establish imminent irreparable harm [or] the probability of prevailing on the merits…”
“As a result of Scilabs inability to complete production on our products, Naturade had no choice but to source production with new vendors in order to continue to servicing our fine retail partners and their loyal customers,” said Rick Robinette, the company’s CEO. “While this has been an unfortunate, but necessary transition, it has given Naturade the opportunity to reformulate and improve all of the products that had been produced by Scilabs with new, state-of-the-art manufacturing partners. Our new manufacturing partners have improved on all aspects of our products including taste, efficacy and higher quality ingredients.”
“Unfortunately, anyone with a lawyer and an axe to grind can file a lawsuit,” continued Robinette, “however we are highly confident that Naturade will continue to prevail in this frivolous case”.
